Key Changes in the Nice Classification: Navigating the 13th Edition (Version 2026)

As of 1 January 2026, the 13th Edition of the Nice Classification (Version 2026) has officially come into force. For trademark owners and practitioners, this update represents a significant shift in how goods and services must be categorized. The World Intellectual Property Organization (“WIPO”) has implemented these changes to better reflect modern commercial realities, moving several major categories of goods into entirely different classes.


Failing to adapt to these changes in new filings can lead to office actions, delays, or even a lack of enforceable protection in the desired market.

The Strategic Reclassification of Essential Oils and Flavourings

One of the most critical updates in the 2026 version concerns essential oils. Under the new rules, the classification of essential oils is now strictly determined by their intended purpose.


  • Industrial Use: Essential oils used as raw materials in the manufacture of other products are now classified in Class 1.

  • Fragrance Use: Essential oils used for fragrance or cosmetic purposes remain in Class 3.


This distinction is vital for chemical and cosmetic companies. Furthermore, a long-standing ambiguity regarding food flavourings has been resolved: All food flavourings are now consolidated into Class 30, regardless of whether they consist of essential oils, which were previously sometimes found in Class 3.


The Migration of Optical Goods and Emergency Vehicles

Perhaps the most disruptive change for the tech and retail sectors is the move of eyewear. Corrective glasses, sunglasses, and contact lenses have been moved from Class 9 to Class 10. This shift acknowledges their primary function as therapeutic or medical devices rather than mere optical apparatus.


Similarly, emergency and rescue vehicles have seen a major relocation. Fire engines, fire boats, and lifeboats, which were traditionally found in Class 9 (due to their "apparatus" nature), are now classified in Class 12 alongside all other land, air, and water vehicles.


Modernizing Fashion, Lifestyle, and Yoga Products

The 2026 Edition brings much-needed clarity to "smart" and specialized consumer goods:


  • Heated Clothing: Electrically heated clothing (such as heated socks or gloves) not intended for medical or safety protection has moved from Class 11 to Class 25, aligning them with standard apparel.

  • Yoga and Meditation: Given the boom in the wellness industry, yoga articles are now split by their nature. Yoga cushions and yoga pillows are in Class 20, yoga gloves in Class 25, yoga mats in Class 27, and yoga blocks in Class 28.

  • Parasols: The classification now distinguishes between hand-held parasols (Class 18) and patio umbrellas (Class 22).


Digital Evolution in Services: AIaaS and Beyond

The services classes have also been modernized to reflect the AI revolution. Artificial Intelligence as a Service [AIaaS] is now officially a recognized entry in Class 42. This provides a clear path for tech companies to protect their cloud-based AI offerings.


Additionally, travel and hospitality services have been refined. Accordingly, booking and arranging access to airport lounges and providing airport lounges is now specifically included in Class 43.


Impact on Existing and New Registrations

It is important to note that these changes apply to new applications filed as of 1 January 2026. Existing registrations will generally remain in their original classes and will not be reclassified during renewal. However, for any new filing strategy or brand expansion, following the Nice 13 (2026) standards is mandatory.


Misclassifying a term can lead to a "Description of Goods" that does not actually cover the product you are selling, leaving your brand vulnerable to cancellation actions for non-use or third-party infringements.


Furthermore, the Turkish Patent and Trademark Office (“TURKPATENT”) is expected to align its standard classification lists with these 2026 updates immediately. Consequently, applicants should pay close attention to these distinctions in all new trademark filings before the TURKPATENT to ensure full compliance and avoid procedural delays.
