Privacy Notice on the Protection and Processing of Personal Data

As Goklu Law & IP Firm (“Data Controller”), we attach great importance to the privacy of private life and the protection of personal data. Pursuant to the Law on the Protection of Personal Data No. 6698 (“Law No. 6698”) and relevant legislation, we would like to inform you about your personal data processed within the scope of your visits to our website.

 

Goklu Law & IP Firm acts as a data controller to a limited extent regarding the provision of website security and operation, meeting communication requests, and information activities. 

 

In this context, the provisions contained in this Privacy Notice shall apply to Personal Data processed regarding you in our capacity as data controller. We would like to explicitly state that data processing activities carried out under direct client instructions within the scope of attorney-client relationships and litigation/consultancy processes conducted with our clients are outside the scope of this "Website Privacy Notice".

Method of Collection and Legal Ground

Your personal data is collected via the website, corporate email servers, and relevant electronic communication and hosting infrastructures used by our Firm; through fully or partially automated means in the digital environment.

These data are processed based on the legal grounds set forth in Art. 5/2 of Law No. 6698:

  • It is expressly provided for by the laws”,

  • "It is necessary for compliance with a legal obligation to which the data controller is subject”, and

  • Processing of data is necessary for the legitimate interests pursued by the data controller, provided that this processing shall not violate the fundamental rights and freedoms of the data subject.

Categories of Personal Data Processed:

The following data may be processed within the scope of your website visits and communication processes:

  • Identity and Contact Data: If you fill out a form or send an email to contact our Firm; Name-surname, email address, phone number, and corporate identity information.

  • Transaction Security Data: For the purpose of ensuring website security and keeping systemic logs; IP address, access logs, connection time information.

  • Request Management Data: Information contained in the content of your legal consultancy requests or questions.

Purposes of Processing Personal Data:

Your personal data categorized above are processed by Goklu Law & IP Firm limited to the following purposes:

  • Evaluation and response to consultancy requests regarding the practice areas of our Firm,

  • Management of communication processes with potential clients or relevant persons, organization of appointments and meetings,

  • Ensuring the security of the website, prevention of cyberattacks, and detection of suspicious transactions,

  • Fulfillment of legal obligations if requested by authorized public institutions and organizations.

Transfer of Personal Data and Cross-Border Data Transfer:

As a rule, your personal data is not shared with third parties for commercial purposes. It may be shared with authorized public institutions and organizations (Courts, Prosecutor's Offices, Enforcement Offices, etc.) only if required for the resolution of legal disputes or requested pursuant to relevant legislation.

Infrastructure-Based Cross-Border Data Transfer:

Our website's hosting, security, acceleration services, and email services are provided through global service providers  infrastructures. Since the servers and data centers of said providers are located abroad (USA, EU countries, etc.) due to technical necessity:

  • When you visit our website, your traffic data generated or information you transmit via communication forms are processed and stored on secure servers located abroad due to the nature of the service.

  • Contacting us using the forms on the website or sending an email implies that you provide your explicit consent for the transfer of your data abroad due to this technical infrastructure.

  • If you do not prefer your data to be transferred to servers abroad; instead of using website forms, you may contact our Firm directly via telephone or our physical address.

Security of Personal Data:

As Goklu Law & IP Firm; we take necessary technical and administrative measures (SSL certificates, firewalls, access restrictions) within the framework of current technological possibilities to prevent unlawful processing of your personal data, to prevent unauthorized access to data, and to ensure its preservation.

Your Rights as the Data Subject:

Pursuant to Article 11 of Law No. 6698, you may exercise the following rights by applying to our Firm, which is the data controller:

  • To learn whether your personal data are processed or not,

  • To request information if your personal data are processed,

  • To learn the purpose of your data processing and whether this data is used for intended purposes,

  • To know the third parties to whom your personal data is transferred at home or abroad,

  • To request the rectification of the incomplete or inaccurate data, if any,

  • To request the erasure or destruction of your personal data under the conditions laid down in the Law,

  • To oppose to the processing, exclusively by automatic means, of your personal data, which leads to an unfavorable consequence for you,

  • To claim compensation for the damage arising from the unlawful processing of your personal data.
