Handling "Too Vague" Provisional Refusals in Türkiye (Madrid System)

When designating Türkiye via the Madrid System, international applicants frequently encounter ex-officio Provisional Refusals. Issued as a Notification of a refusal of protection not based on an opposition pursuant to Rule 17(2) of the Common Regulations, these refusals stem from the Turkish Patent and Trademark Office's ("TPTO") strict practice regarding broad or indefinite specifications of goods and services.
Where Do Applications Get Caught?
TPTO requires clear itemization. Broad or generic descriptions across various Nice classes are regularly flagged as "too vague":
Class 35 (Most Frequent): Terms like "retail services", "wholesale store services", "online retail services", or "demonstration of goods" are routinely rejected unless tied to specific products.
Other Classes (Class 9, 37, 42, etc.): Generic phrasing such as "software", "installation services", or "technical data analysis" without detailing the field or function often faces the exact same refusal.
The Required Action: Limitation & Appeal
To overcome the refusal, you cannot simply submit an informal clarification to WIPO; you must formally appeal before the TPTO
:
Specific Limitation: Restrict the broad terms by limiting them to concrete goods or fields (e.g., amending "demonstration of goods" to "demonstration of 3D spectacles", or "retail services" to "retail services for battery chargers").
Official Appeal Fee: The response requires filing a formal appeal before the TPTO, which involves paying the official appeal fee through a local Turkish trademark attorney.
The 2-Month Rule & Consequence of Inaction
The appeal, along with the required fee payment and specification amendment, must be submitted within 2 months from the date of notification by WIPO.
If no appeal is filed within this strict 2-month window, the rejected goods/services will be permanently excised from the scope of the trademark application in Türkiye, and protection will only be granted for any remaining terms.
